Garnishment Actions

  • A creditor can legally seize a debtor's money in the possession of a third party by using a garnishment. These usually are wages from a debtor's employer or money from a debtor's bank account. This action can be taken by both private creditors and government creditors. Certain monies are exempt from garnishment, based largely on the type of debt that is involved. Federal law provides exemptions regarding exemption amounts and state law exempts certain types of monies.
