Moped Laws in South Dakota

The state of South Dakota has laws in place regarding the operation of two-wheeled vehicles. Under state law, mopeds are considered motorcycles, and any laws regarding their operation will be the same as those regarding the operation of motorcycles with some exceptions. - Unlike a motorcycle, which requires special qualifications to operate, a person wishing to operate a moped in South Dakota needs only a valid driver's license.
- Anyone under 18 must wear a protective helmet. This applies to both drivers and passengers. Anyone operating a moped must either wear protective glasses or have a windscreen high enough to shield the eyes when seated in a normal driving position.
- People operating mopeds cannot drive between two lanes of traffic or stay in the same lane when attempting to pass a vehicle. They must move into the next lane like a car would. No more than two mopeds can drive next to each other in one lane. Mopeds are not allowed in park and recreation areas.
- South Dakota requires insurance providing defined minimums of coverage for mopeds and other vehicles classified as motorcycles. Liability insurance minimums include $25,000 for injury or death of one person, $50,000 for more than one and $25,000 dollars for property damage.
