When basic principles of democracy are violated?
When basic principles of democracy are violated?
Dalip Singh Wasan, Advocate.
We all know that the basic principles of democracy are that there should be a government of the people, by the people and for the people and to achieve these ends, we elect people and then we allow them to sit in a parliament or in a state legislative assembly and then give them time and opportunity to run the administration of the country. They sit together and initiate bills, discuss on the provisions of the bill and then after due additions and deletions, they pass the bill. The bills become law of the country and then the executive carries out the provisions of the Act and the judiciary has an eye on the executive that they may not violate the law passed by the legislative. It clearly means that everything must be initiated in these august houses and they must discuss the matter fully and then pass laws for operation in the country. Anybody who wishes that there should be some addition or deletion, he must reach the parliament or the state legislative assemblies through the elected members and non one should be allowed to come on the street and start demanding certain amendment or addition in the law. When we have conducted the rehearsal of elections, we must believe in the competency, honesty and the integrity of the people who have been elected and allowed to function in our august houses. We should not take up any matter directly and if we need such an instance, we must utilize the members who have been elected to represent us and we should always speak through them and not otherwise.
We have noted that democracy has failed in all the countries because often the people come on the streets and roads through processions, rallies, meetings, strikes, hunger strikes and they press the government of the time to accept certain demands and when the state fearing damages accepts such demands, it means the democratic set up has failed because when there are elected bodies and institutions in the country, no matter should be decided out of these institutions. When governments are to function under pressures they do not work in a democratic way and therefore, it is most necessary that such processions, rallies, protests, agitations, strikes and hunger strikes should be banned and the people should approach the legislative through the members they have elected and they should not work out of the parliament and the state legislative assemblies. Mostly such agitations are organized by individuals or by the oppositions and even the ruling political party itself can cause such agitations because they want some amendment which the allies are not permitting.
We have noted that even in India there had been certain decisions under force and those decisions are defective and have been causing much harm to the people who demanded certain amendments under force. Therefore, all such agitations must be banned because these are harmful to the country and some people come up higher in their political position at the cost of the people.
