Sexual Predator Laws in Florida
- In the state of Florida, sexual predators are defined as individuals who have performed egregious crimes against minors. After receiving this title, sexual predators must be registered throughout the state of Florida on a semiannual basis that keeps track of their changing looks and vital statistics so that they can be monitored more closely in case of crime repetition. Individuals have the right to know about sexual predators who live in their neighborhood.
- Someone who is convicted of kidnapping, false imprisonment or luring and enticing a child without a pardon where the victim is a minor and the defendant is not the victim's parent shall immediately be considered a sexual predator. Further, those found guilty of trafficking in minors for prostitution, sexual battery, sexual performance by a child and/or lewd or lascivious offenses committed upon or in the presence of persons less than 16 years of age are also sexual predators.
- A sexual predator must register his name; Social Security number; age; race; sex; date; of birth; height; weight; hair and eye color; photograph; address of legal residence and any temporary residences; date and place of employment; date and place of conviction; fingerprints; and a description of the crime with the state of Florida and the local law enforcement as defined by the address of current residence. Further, a sexual predator must acquire a driver's license or state ID card identifying himself as a sexual predator. Every six months, a sexual predator must re-register with the same information at the local sheriff's office.
- All sexual predator lists in Florida are public record and can be accessed in person at any police precinct or by calling a toll-free number used for this purpose. Further, online records and locations of sexual predators may be found through the Florida Sex Offender's website.
- Within 48 hours of a sexual predator moving into an area, the local sheriff must inform all licensed day care centers and elementary, middle and high schools within a one-mile radius about the presence of a sexual predator.
- Under no circumstances are the names of victims to be released when notifying the public about the presence of a sexual predator in the vicinity.
- As of July 1, 2007, sexual predators in Florida are no longer allowed to petition the court for the removal of the sexual predator designation, and as such, registration is required for life. In some cases, those who have gone 25 years without being convicted of any felony or misdemeanor may petition the court to remove sexual offender status provided it does not conflict with the sexual predator status.
